The Rules and Guidelines for Short&Sweet.

Acceptance of Terms and Conditions
Using the Short&Sweet website in any way constitutes your acceptance of these entire Terms and Conditions. Short&Sweet has the right to change or amend these Terms and Conditions without further notice.

General Terms and Conditions

Definitions

“Short&Sweet”, “S&S”, “we”, “us”, means the company trading through https://shortandsweet.tv/ and registered as Short&Sweet Film and Events pty. ltd.

“Audience membership” describes the account type which allows short film lovers access to the wider Short&Sweet network.

“Artist” means a creative involved in the making of moving image short film.

“Artist membership” is a creative involved in the making of short film who has or has a Short&Sweet Artist membership

“Creative” or “Creatives” means a member who has or has held a Creative account.

“Content” means any moving image or short video made by an artist, filmmaker

“Brief” means the description of what video content you require.

‘Partners’ mean individuals or organisations with whom Short&Sweet barters promotional and other mutually beneficial activities.

“Film Cafe” is the name of the live Short&Sweet venue.

“Short Film Cafe” is the name of the “Artists” hub – the Short&Sweet Connect

“Cities” refers to the Short&Sweet communities around the world. Cities host events and network evenings.

“Short&Sweet Filmmakers Fund” refers to the yearly fund made possible by the short film audience and donated to one Short&Sweet filmmaker whose film has been selected for Short&Sweet’s weekly show.

Copyright & Intellectual Property Rights
All content and materials on the Short&Sweet website are protected under copyright and intellectual property rights laws of England and Wales and under similar international legislation. Short&Sweet owns and retains all intellectual property and proprietary rights to all materials in the Short&Sweet site, excluding content published or linked by its members. No part of the Short&Sweet site belonging to Short&Sweet may be copied, reproduced, distributed or published without Short&Sweet’s’ written permission. Users confirm that all media and content published or linked to on the Short&Sweet site is:

  • copyright free and/or
  • copyright approved to link to the site and/or
  • copyright owned by you.

It is your responsibility to understand and identify what is copyright in your content and how copyright approval can be secured.

Defamation
You confirm that by publishing or linking content to Short&Sweet you accept responsibility for that content and that the content is neither offensive nor defamatory.

Promotion
Any films submitted to Short&Sweet via the submissions page or Artist membership give Short&Sweet the right to promote you, the artist, via the Short&Sweet channels. You will be kept up to date with all channels of promotion e.g. screenings around the world, specialised events, broadcasters and online distribution (terms & conditions per offer will be approved by you, the Artist, before any commitment is made)

Artists give Short&Sweet  the right to promote any content you commission via the Short&Sweet connect portal, via a link to the label/artist’s YouTube site, for the purpose of promoting the content and  YOU, the artist and/or Short&Sweet

Artist membership does not guarantee a screening at Short&Sweet, and only

Membership Cancellation
You may cancel your membership at any time by emailing a request to membership@shortandsweet.tv. Any subscription fees already paid will not be refunded, except allowing for the refund policy as stated below. You are free to cancel your subscription at any time.

Membership Termination
We may terminate your membership if you breach these Terms and Conditions or deliberately seek to circumvent payment or security measures deployed at Short&Sweet or if we deem it appropriate.

If your membership is terminated by us your subscription fees may be forfeit. Termination based on misuse of the Short&Sweet portal or breach of these Terms and Conditions will be at Short&Sweet’s sole discretion.

Pricing and Price Changes
Short&Sweet reserves the right to change or introduce charges at any time without prior notice.

Profile Information

Artist Membership:
You agree we may, when necessary share your email address with potential clients or directors in relation to briefs created on the site, or in relation to the ‘Recommended’ creatives database, shared with stated Production Companies and Reps.

Audience Membership
Your contact details are for the use of Short&Sweet only and will not be used or distributed to anyone at anytime. You will only receive invitations via email from Short&Sweet or the Film Cafe for special events, workshops or opportunities that suit your profile.

Mailing List
Your email address is automatically added to our mailing list when you create an account on Radar. You can unsubscribe via the link in the email or request to unsubscribe by emailing info@shortandsweet.tv

Partners
Nothing in these terms and conditions shall be construed as constituting, or deemed to constitute, a legal partnership or agency between the individuals or organisations noted on the website as ‘Partners’ and neither party shall have any authority to bind the other in any way. The relationship of the parties shall be as independent contractors.

Submissions and Security
It is FREE to submit your film to Short&Sweet. We accept old and new short films, music videos and short animations no longer than 15 minutes.

Submissions do NOT guarantee a screening at Short&Sweet. Artists / Filmmmakers whose films have been selected to screen at Short&Sweet will be required to do one of the following:

  • Submit a 2 minute video introduction that can be played before their film screens.
  • Video interview with Julia for On The Couch with Short&Sweet
  • Recorded skype interview with Julia for On The Couch with Short&Sweet

Selected filmmakers will be given the choice of 2 dates for the Short&Sweet live screening of their short film, which will make up 1 of 8 selected short films that evening.

Selected filmmakers will be required to submit a high res .mp4 H264 download link of their film for the Live Short&Sweet screening.

Short films submitted to Short&Sweet via the Short&Sweet Connect portal or the submission page are protected via CustosTech. Short films will not be shared or distributed without the permission from the filmmakers or content owners and will only feature as part of a Short&Sweet curated programme.

Our Liability
You agree that we will not be liable for any loss or damage you incur (including but not limited to loss of profit, loss of business, loss of revenue, or any other incidental or consequential loss or damage) whether indirectly or directly caused by Short&Sweet or by the use of the site.

Terms and Conditions relating to Short&Sweet CONNECT

  1. Short&Sweet Connect Terms and Conditions apply to content commissioned through Short&Sweet Connect.
  2. Artists who supply content links to Short&Sweet must obtain the consent of all rights owners in the content, with the full knowledge and consent of copyright owners to these terms and conditions.
  3. Short&Sweet Connect members agree videos commissioned or originated via the portal may be linked on Short&Sweet channels, and on any other blogs and websites that we in our sole discretion may select, without other prior agreement, one week after the release date of the video. Short&Sweet agrees films will not be promoted provided the Client or Creative submit written notification. It is the responsibility of the Client or Creative to ensure such notification is received by Short&Sweet.
  4. The Artist supplying short films or Video links to Short&Sweet is responsible for confirming in writing any restrictions regarding usage of the Videos, including requirements which apply to metadata .
  5. Artists and Clients expressly acknowledge that it is the responsibility of third party sites where Videos are shared to obtain the necessary mechanical licenses, and to make royalty payments and other payments required by law. Short&Sweet may, on occasion, advise you as to whether a third party site is not taking responsibility for this, in which case responsibility to obtain licenses and make any required payments passes to you.
  6. The Client or Artist supplying the short film or Video link warrants they have obtained all necessary consents for usage of the Video from all copyright owners in the Master, including all rights relating to the music of the Master. They warrant that the Masters do not infringe the rights of any third parties and agree to hold harmless and indemnify Short&Sweet against any costs, claims or damages from any third parties.

 

Terms and Conditions relating to Artists

  1. Artists understand that Short&Sweet is providing a means for Content Needers and Content Makers to trade with each other and we are not liable or responsible for any artistic or production issues that may arise from Artists’ relationships with the clients / content needers.
  2. The named director on the treatment will direct the film should the treatment be commissioned.
  3. Artists agree to supply honest and truthful information about their film career and credits to Short&Sweet for Short&Sweet Connect promotion. It is the responsibility of Directors to supply references to the client and Short&Sweet if requested.
  4. Clients are able to raise a complaint against an Artist if they believe the Artist has failed to deliver the video the Artist pitched, according to the budget advertised, to the brief supplied by the client, and/or to timecales stated. Artists may be deleted from the Short&Sweet Connect portal if Short&Sweet agrees with the client’s complaint.
  5. Artists are recommended to agree to confirm all agreements regarding delivery deadlines, cashflow payments, insurance, deliverables and other relevant information in writing with the Client and prior to commencement, preferably using a formal contract.
  6. Artists are recommended to agree a payment upfront, with 50% payment from client to commence pre-production and the balance due on sign off of final film. Final film should ONLY be delivered to client once full payment has been mades.
  7. Clients are able to raise a complaint against an Artist if they believe any content in the commissioned video is not copyright cleared, or that insufficient or inappropriate release forms have been used Artists may be deleted from the Short&Sweet Connect portal if Short&Sweet agrees with the Client complaint.
  8. If the Client changes the brief after commission or does not pay an Artist as agreed, please contact us as we may wish to deny future access to one or other party. Please be aware Artists best protection against harmful practise is ultimately via the contract between Content Needer and Content Maker.

 

Terms and Conditions related to Content Needers

  1. Artists understand that Short&Sweet is providing a means for Content Needers and Content Makers to trade with each other and we are not liable or responsible for any artistic or production issues that may arise from Artists’ relationships with the clients / content needers.
  2. Content needers will be required to sign up and pay a membership fee which will be deducted from the video commissioned. This is to ensure that Artist time and effort are not wasted by content needers who are content wishers.
  3. Subject to receiving an appropriate treatment, Labels agree to commission the Creative who submitted the treatment. Labels understand that the content of each treatment is confidential and agree not to disclose or otherwise make available treatments to any third party other than the artist.
  4. Clients understand that Short&Sweet may withdraw a brief if the artist or client does not have a substantial online presence.
  5. Clients acknowledge that Short&Sweet always recommends taking references from previous clients prior to commissioning an Artist.
  6. Artists agree they will not substantially alter the brief after it has been submitted, unless the change is discussed with Artist and Short&Sweet.
  7. Clients agree to wait until the pitch deadline set out in the brief has expired before commissioning a Creative.
  8. Artists are able to raise a complaint against a Client if they believe the Label has failed to pay the budget advertised, according to the payment timescales agreed between them and/or if they believe the Label has changed the production or delivery requirements after commission, for example by requiring changes that would require extra budget. Labels may be banned from using the site if Radar agrees with the Creative’s complaint.
  9. Clients are recommended to agree to all matters regarding delivery deadlines, cashflow payments, insurances, deliverables and other relevant information in writing with the Creative and prior to commencement via a formal contract.
  10. Labels who have commissioned via Radar give RadarMusicVideos the right to use company or band logos, for the purpose of promoting the video and/or RadarMusicVideos.
  11. If a Creative fails to deliver according to a submitted pitch, the budget advertised or the timescales agreed, please contact us as we may wish to deny future access to one or other party. Please be aware the best protection against harmful practise is taking references and ultimately via the contract between Label and Creative.
